A Superintendência-Geral do Conselho Administrativo de Defesa Econômica (SG/Cade) instaurou hoje investigações sobre suposta troca de informações concorrencial e comercialmente sensíveis contra empresas atuantes no mercado de corretagem de seguros e resseguros para aviação e aeroespacial e serviços auxiliares relacionados.
São investigadas: American International Group, Amlin, AON UK Limited, Aspen Insurance UK, JLT Speciality Limited, Liberty Global Group, Marsh Limited, Tokio Marine Kiln Group Limited, United Insurance Brokers Limited, XL Group plc e Willis Group Limited, além de trinta pessoas físicas ligadas a essas companhias.
De acordo com informações divulgadas pelas autoridades, a conduta anticompetitiva teria se iniciado no exterior, mas teria potencialmente afetado o mercado brasileiro. O suposto compartilhamento de informações sensíveis teria ocorrido em dois momentos: início em meados da década de 1980 e, após, de 1997 até pelo menos abril de 2017. As informações envolvem dados recentes e detalhados de concorrentes sobre precificação e condições de contratação relativos a seguros e resseguros para aviação e aeroespacial e eram trocadas por meio de fax, e-mail, telefone e em reuniões bilaterais e multilaterais.
Com a instauração do Processo Administrativo, os acusados serão notificados para apresentar suas defesas e, caso condenados pelo Tribunal Administrativo do CADE poderão ter que pagar multas equivalentes a até 20% do faturamento bruto anual da empresa em 2018 (art. 37 da Lei 12.529/2011).

Brazil’s antitrust watchdog is investigating 11 aviation and aerospace insurance and brokerage companies
The General Superintendence of the Administrative Council for Economic Defense (SG/Cade) launched an investigation today on an alleged practice of exchanging competitive and commercially sensitive information in the market for aviation and aerospace insurance and reinsurance brokerage and related ancillary services.
The companies investigated are: American International Group, Amlin, AON UK Limited, Aspen Insurance UK, JLT Specialty Limited, Liberty Global Group, Marsh Limited, Tokio Marine Kiln Group Limited, United Insurance Brokers Limited, XL Group plc and Willis Group Limited, in addition to thirty individuals linked to these companies.
According to the information released by the authorities, the anti-competitive conduct would have started abroad, but would have potentially affected the Brazilian market. The alleged sharing of sensitive information occurred in two different moments: in the beginning of 1980s and, after, from 1997 through at least April 2017. The information involves recent and detailed data from competitors on pricing and contracting conditions relating to aviation and were exchanged through aerospace insurance and reinsurance by fax, email, telephone and at bilateral and multilateral meetings.
Upon initiation of the Administrative Proceeding, the defendants will be notified to present their defenses and, if convicted by CADE’s Tribunal, they may have to pay fines equivalent to up to 20% of the company’s gross annual revenues in 2018 (article 37 of Law 12,529 / 2011).
